Privacy policy

Upskew Pty. Ltd. (“Upskew”) operates Upskew.com, the Encode for Android app, and the Encode for iOS app. It is Upskew's policy to respect your privacy regarding any information we may collect while operating our websites or apps.

You may access, delete or correct your personal data by contacting our support team. To protect your identity, we require evidence of identity to process your requests.

Visitors

Like most website and app operators, Upskew collects non-personally-identifying information of the sort that devices and servers typically make available, such as the device type, language preference, referring site, and the date and time of each visitor request. Upskew's purpose in collecting non-personally identifying information is to better understand how Upskew's visitors use its websites or apps.

Upskew uses a number of third-party tools including Google Analytics (to measure and analyze usage), Google Firebase for our Android apps (to enhance app quality by enabling app invites, and app customization) and Microsoft HockeyApp (for basic metrics, feedback and crash reporting). These third-party tools may use cookies and similar technologies in order to collect information. This privacy policy does not cover the use of data by third-party tools.

Gathering of Personally-Identifying Information

Certain visitors to Upskew's websites or apps choose to interact with Upskew in ways that require Upskew to gather personally-identifying information. The amount and type of information that Upskew gathers depends on the nature of the interaction. In each case, Upskew collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor's interaction with Upskew. Upskew does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related or app-related activities.

Some examples of cases when you may provide Upskew with potentially personally-identifying information includes:

  • if you choose to send us a request (for example via a support email or other feedback mechanism)
  • if you sign up to test early release Upskew apps
  • Protection of Certain Personally-Identifying Information

    Upskew discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Upskew's behalf or to provide services available at Upskew's websites or apps, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Upskew's websites or apps, you consent to the transfer of such information to them.

    Other than to its employees, contractors and affiliated organizations, as described above, Upskew discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Upskew believes in good faith that disclosure is reasonably necessary to protect the property or rights of Upskew, third parties or the public at large. Upskew takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

    Upskew will not rent or sell potentially personally-identifying and personally-identifying information to anyone.

    Business Transfers

    If Upskew, or substantially all of its assets, were acquired, or in the unlikely event that Upskew goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Upskew may continue to use your personal information as set forth in this policy.

    Ads

    Ads appearing on the Encode for Android app may be delivered to users by advertising partners, who may use device identifiers and/or cookies. These device identifiers and/or cookies allow the ad server to recognize your computer or device each time they send you an online advertisement to compile information about you or others who use your computer or device. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy does not cover the use of cookies and/or device identifiers by any advertisers.

    Privacy Policy Changes

    Although most changes are likely to be minor, Upskew may change its Privacy Policy from time to time, and in Upskew's sole discretion. Upskew encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site or our apps after any change in this Privacy Policy will constitute your acceptance of such change.
